DrDictation - Terms of Service

Welcome to DrDictation. By using our services, you agree to the following Terms of Service. Please read them carefully. If you do not agree, do not use our platform.
1. Eligibility & User Responsibilities
- Users must be licensed healthcare professionals or allied clinicians to use DrDictation.
- Users are responsible for obtaining patient consent before uploading any medical letters for transcription.
- Users must ensure compliance with all applicable privacy laws, including Australian privacy laws (Privacy Act 1988) and U.S. HIPAA regulations.
2. AI Transcription & Accuracy
- DrDictation only transcribes medical letters; a separate AI system formats them.
- Transcriptions may contain errors, and users must review and verify accuracy before using them.
- The service does not provide medical advice, diagnoses, or treatment recommendations.
- Transcription quality depends on audio clarity. Background noise, accents, and speech patterns may affect accuracy.
3. Data Storage & Security
- Transcribed letters are stored in a secure database, but DrDictation does not access patient data.
- Users can access only their own transcriptions.
- DrDictation follows both Australian privacy laws (Privacy Act 1988) and U.S. HIPAA regulations to ensure data security.
- Encryption and access controls are used to protect data.
- While we take reasonable security measures, we cannot guarantee absolute security (e.g., against hacking or cyberattacks).
4. Prohibited Uses
Users may not use DrDictation to:
- Upload non-medical or misleading information.
- Submit third-party or copyrighted content without permission.
- Engage in illegal, fraudulent, or unethical activities, including falsifying medical records.
5. Limitation of Liability
- DrDictation is not responsible for any harm, errors, or misinterpretations arising from transcription use.
- The service is provided "as is" without warranties of accuracy, reliability, or availability.
- DrDictation is not liable for financial loss, data loss, reputational damage, or indirect damages caused by transcription errors.
6. Account Suspension & Termination
- DrDictation reserves the right to suspend or terminate accounts that violate privacy laws, HIPAA, or these Terms.
- Users may receive a warning before termination, but in severe cases, accounts may be suspended immediately.
- No refunds will be issued for terminated accounts.
7. Pricing & Payments
7.1 Subscription & Pay-Per-Use Model
- DrDictation offers both subscription-based and pay-per-use pricing.
- Users can choose between a recurring subscription plan or one-time payments per transcription.
7.2 Payment Processing
- All payments are securely processed through Stripe.
- By subscribing, users authorize DrDictation to automatically charge their payment method for recurring payments.
7.3 Refunds & Cancellations
- Payments are non-refundable, except where required by Australian Consumer Law.
- Users may cancel their subscription anytime, but access will continue until the end of the billing cycle.
